On March 24, 2026, Manitoba introduced Bill 201, The Employment Standards Code Amendment Act (Right to Religious Observance), which, if passed, would strengthen protections for religious observance in the workplace.
Employees who do not observe Good Friday or Christmas Day would be able to make substitution requests for another day that aligns with their religious beliefs. Employers would be required to reasonably accommodate employees’ religious practices during the workday, which may include flexibility in scheduling or permitting attire consistent with their beliefs.
In addition, retail employees who provide advance notice would be able to refuse to work on Fridays, Saturdays or Sundays for religious observance.
This Act would come into force on the day it receives royal assent.
Once the legislation is effective, employers in Manitoba should:
- Review and update workplace policies and scheduling practices;
- Train managers and HR staff; and
- Establish clear processes for handling substitution requests and maintaining open communication with employees to support an inclusive work environment.
