New Requirements Related to Publicly Advertised Jobs

On January 1, 2026, Regulation 476/24: Rules and Exemptions Re Job Postings came into effect, introducing new compliance obligations for publicly advertised job postings and job posting platforms, including the requirement for employers to include salaries in publicly advertised job postings. 

 

Further amendments announced by the Ontario government introduce additional transparency measures, including: 

 

  • Compensation transparency limits: Any salary or wage range included in a publicly advertised job posting must not exceed $50,000 per year; and  

 

  • Artificial intelligence disclosure: Employers must clearly state whether artificial intelligence (AI) is used to screen, assess or select applicants. 

 

Employers with 25 or more employees must: 

 

  • Ensure their publicly advertised job postings comply with these requirements; 
  • Review and update all job postings, recruitment policies to ensure compliance; and 
  • Add clear, plain-language disclosures regarding the use of AI in recruitment.
