Elimination of Medical Note Requirement for Sickness-Related Leaves

On May 31, 2024, the government of Quebec introduced Bill 68 to amend the Act respecting labour standards to prohibit employers from requiring documentation, such as a medical certificate, to explain the reasons for an absence. This applies specifically to the first three periods of absence each year, provided they do not exceed three consecutive days and include absences due to sickness related to the following leaves: 

  • Child Death & Disappearance Leaves 

  • Compassionate Care Leave 

  • Critical Illness Leave  

  • Domestic & Sexual Violence Leave 

  • Organ Donor Leave 

  • Personal Leave 

  • Sick Leave  
     

If passed, employers must revise and update their sick leave policies to align with the abolition of the medical note requirement in certain situations. 

The National Payroll Institute will monitor the progress of this Bill and advise its members accordingly.
