On May 3, 2024, the Ontario Government announced that they will be tabling legislation to create a more equitable hiring process for job seekers and impose stricter penalties for employers who violate the Employment Standards Act (ESA).
The upcoming legislation will include an increase in the maximum fine for ESA violations from $50,000 to $100,000 for individuals, marking the highest penalty of this type in Canada. Additionally, regulatory changes will raise fines for repeat offenders from $1,000 to $5,000 if they breach the same ESA provision three times or more. These offenses encompass failures such as neglecting to pay wages, penalizing employees for taking pregnancy or parental leave, and gender-based unequal pay for equivalent work.
The government also plans to amend the ESA to require larger employers to disclose vacancy statuses in job ads and to respond to interviewed applicants, potentially making it the first Canadian province with such mandates.
The National Payroll Institute will monitor the upcoming legislation and advise its members accordingly.
