Death or Disappearance of a Child receives Royal Assent

On June 22, 2023, Bill C-47 received royal assent. Division 15 of Part 4 of Bill C-47 amended the Canada Labour Code in respect of leave related to the death or disappearance of a child to, among other things, increase the maximum length of that leave from 104 weeks to 156 weeks and repealed paragraph 206.5(4)(b) of the CLC.

A child means a person who is under 25 years of age.

The period when the leaves may be taken (a) begins on the day on which the death or disappearance, as the case may be, occurs; and (b) ends 156 weeks after the day on which the death or disappearance, as the case may be, occurs. 

An employee is not entitled to the leave if they are charged with the crime.
